So, we have now learned that Miss Wilding did not get the photo in question from this site and therefore did not appropriate it from Al or violate any honor or trust we hold among ourselves.  It appears from my google search that there are sites that contain photos for free download that don't credit an individual photographer.  It seems to me that the Gentlemen on this forum owe Miss Wilding an apology now for some of the harsher words and stances taken.  Oh, and to the fellow that assumes that "everyone" knows the ins and out of the law of copyright and trademark my only response can be -"Are you serious?"  One must obtain an undergraduate degree in one of the sciences and then go to law school just to sit for the specialization.  I have practiced trial law in Texas for 31 years and am A V rated and I had no idea that the law had changed as setforth in a previous reply.  Al, if you have a beef you should discover who harvested your photo and take it up with them.  This thread reminds me of the Federal Government spending millons on the prosecution of kids that downloaded music from the internet sources instead of chasing the real wrongdoer.

As I see it, we have only learned that Miss Wilding says she got it from a different website. Seems likely to me, but until she posts the website where she found it, we'll only have the word of someone who used an "uncredited" picture taken by somebody else for a commercial purpose.

And I do believe Miss Wilding is the first woman with a first name "Keith" that I've heard of.

Good thing you haven't paid a dime out of your pocket for this thread.

...instead of chasing the real wrongdoer.

And, whom might that be?

Not that it can't be stripped out, but I always make sure that my contact information is in the exif data information of my images.  That way, if I ever do see an image of mine somewhere where it shouldn't be (it has happened once that I know of), I can prove with the exif data that is it mine.  In the one situation that it did happen, the person actually admitted in their post when they posted it that it was copyrighted but figured it would be ok, hahahaha.

I just want to encourage people that post images to any internet website to add their contact information to the exif data to help protect themselves.

In Lightroom, this is easily achieved by creating a metadata preset, then apply it to your images.  I apply the metadata preset to all of my images during import, that way it is always there.  Plus, when I export the RAW images to other formats, such as TIFF or JPEG, I can just check the box to add the copyright watermark, which uses the 'copyright' field of the metadata preset.

If anyone uses Lightroom and needs help setting up the metadata preset, I will be happy to lend a hand.

The information in the exif data can be easily viewed on any PC (I don't know how on a MAC) by going to the properties of the image, then go to the summary tab (you may need to click the advanced button after going to the summary tab).

Cheers =)

Moderator note: see EXIF/IPTC Editors topic for further discussion on editing metadata.

To Vista Grande,  In my opinion the wrongdoer in the music industry litigation were the commercial sites that stripped music from the artists and then distributed it on the internet.
And your commit about me not paying for a thread, what is that all about?  Is there now a fee for expressing an opposite opinion or using a misguided Federal witchhunt as an analogy?

To Vista Grande,  Boy you have lost me now. I have no idea what you meant to say. I would like to respond in kind but your message was a bit too subtle for me.

VG would be horrible in deposition insisting on using analogies in response to questions!

Mr. Wilding and I are in contact and will be talking soon.  He is acting in good faith.

I have no first hand knowledge.

To the side, it's amazing what can be done with today's surgical procedures!

Al, please tell us this is moving forward?.
Whether or not Al's negotiations with Wilding move forward are irrelevant to the ongoing argument, which will only subside after wilding posts a response to the question of the site on which Al's picture was found. Until wilding steps up and answers the question, we'll be stuck with more analogies. :icon_rolleyes:

Wilding,
I move that you either disclose the website, or throw us the huge bender that Al is demanding for his loyal hiking buddies in the mediations. We might even promise to behave. Sort of.
We'll decorate the Holland with lots of pretty pictures and bring in a herd of javelina to clean up after us.

All is well that ends well.  Wilding and I, and it is Ms. Wilding, just got off the phone and have reached an agreement for compensation for the use of my photo.  Let me add, I am getting nothing, but she is accommodating a couple of friends of mine.  She has also promised to try to determine the site where she and her graphical artist found the photo.  I have emphasized the importance of determining who is taking photos from this site and posting them elsewhere and she agrees.  It will be next week before she completes this effort.

Again, I am satisfied with the resolution of this matter and Ms. Wilding has been very responsive and responsible in her response.
