Curious to see how this will turn out, but at this point I'm calling b.s. on these guys...

PRESIDIO COUNTY — A late-night shootout with an unknown attacker or attackers, potentially from Mexico; an attempted RV theft or kidnapping; two men wounded as result of lax border security. This is part of a dramatic narrative circulating on the internet about a Friday night incident that left two men with severe gunshot wounds.

According to local law enforcement, however, the story is not supported by evidence at this point.

According to local law enforcement, however, the story is not supported by evidence at this point.

Concocted stories always get outed in the end. The more elaborate, the quicker it occurs.

Time will tell.

A motion to delay New Mexico hunting guides Walker Daugherty and Michael Bryant’s final plea deadline to May 8 was approved by 394th District Judge Roy Ferguson on Tuesday, following the introduction of new evidence from the defense.

According to Daugherty’s attorney Liz Rogers, a bullet lodged in the hunting guide following last year’s shootout at the Circle Dug Ranch in south Presidio County has been studied by a ballistics expert, who alleges that the bullet doesn’t match any of the firearms used by the hunting party the night of the fracas.

The ballistics expert, Rogers said, measured the bullet using x-rays taken in the hospital following the incident and a second x-ray taken recently.

The incident also left a Florida chiropractor wounded.

“What he saw was that the bullet was definitely not a .223 from an AR-15 and that the bullet didn’t match any of the guns seized after the shooting,” Rogers said, adding that the slug appears to be from a .40 or .38 caliber gun. “The bullet is definitely not from the party, so it must have been from an intruder.”

The bullet lodged in Daugherty, she added, cannot be extracted.

According to Presidio County Sheriff’s Office Chief Deputy Joel Nuñez, there was no evidence at the scene of an intruder, and two separate interviews with Bryant have indicated that the shooting was done entirely between members of the hunting party.

“It doesn’t change the fact that Bryant himself said he shot toward the RV to take out the driver and toward Daugherty,” Nuñez said. “Bryant did state twice – once here in Presidio County and once to a Texas Ranger in El Paso – that he shot at the RV and was in a position where he could have shot Daugherty.”

Only one other slug was found and submitted for ballistics testing, Nuñez said, which matched a gun from the hunting party.

A second motion from the two alleged shooters’ attorneys requesting a change of venue was also filed, with a decision from Judge Ferguson expected on the May 8th docket call.

Daugherty and Bryant were each indicted on one charge each of 3rd Degree Felony Deadly Conduct/Discharge of Firearm, and indicted on one new charge each of 2nd Degree Felony Aggravated Assault with a Deadly Weapon following the January 6, 2017 incident.

They have been subsequently been named as plaintiffs alongside Bob Daugherty (dba Big Rim Outfitters, formerly known as Red Wing Outfitters) and the Circle Dug Ranch Partnership in a $1 million lawsuit filed by Paul Roberts, the chiropractor wounded in the shootout.
