I suppose that means you are the landlord and own the buildings, but are not the owner/proprietor of the restaurant and cantina business... ?

Correct, you would own the land and the buildings but you don't get the business, i.e. the name La Kiva, the menu, intellectual property or anything else that would go with that restaurant business.  You could open a restaurant there but not call it La Kiva.  It would be like buying a old food truck, you just get the truck, not the business that used to be in the truck.

Hmm, I thought I read somewhere that the property is not up to code and any change of ownership would require upwards of $100K to be code compliant.

Don't know if that is true, but (not that I could afford it anyway), with or without the proprietorship, it is way overpriced. IMHO.

Brewster County Appraisal District has the RE valued at $46K with the fixtures maybe another $37K (can't see the details on these to know for sure).  So, yeah, the taxes are only $715 now but will go way up if sold at a higher value.

I'm not sure what value the La Kiva name would have once separated from the RE.  If you're going to re-start the business in a different location in BIBE,....why move?  And the name would appear to have little value outside the area.  Maybe they are just going to retire the name in Glenn's honor.

In this case the (quirky/weird) building is synonymous with the business. I think anyone going in there would have a little boost that it was La Kiva, but at the same time an outsider would struggle with the locals who may see someone from the outside trying to cash in.   
Everything is in walking distance if you have enough time.
